I did not see a resisting charge, and I did state earlier that if he was charged with assaulting the cops that is a serious matter. However, whatever your life experience, mine is 30 years in the Courts. So I know very well how the system works. For your information, here in New York (upstate is the place of occurence, maybe SUNY Binghamton) there was a similar incident a few years ago involving a basketball player from Serbia who was probably BIGGER than Nik. He almost beat another student to death. The other guy was a little nerdy guy who was around 5'7 165, so the mismatch is pretty obvious. The VICTIM (unless he had a gun he was a victim because that could never be a fair fight) was in a coma for more than a month and almost died. Meanwhile, the Serbian Counsel in NYC sneaked the Serb hoopster out of the country after a Judge set bail too low. This started an international incident, with the State Department and Sen Schumer getting involved. The Serbs REFUSED to send him back for trial, and eventually agreed to try him in Serbia (where he probably got two hours detention as a penalty). The point is, THAT was a serious case. The victim almost died, and has brain damage and is now disabled. In THIS case the DJ stated he was not injured. There are no Felony charges. I presume this is a first arrest for Tree (at least I hope so). My 30 years of experience tells me the case will basically go away with a slap on the wrist, which could be community service or even some type of supervision,. But in the end, I think it will be seen as a bar fight. And I have to tell you, in most bar fights no one even gets arrested unless there is a serious injury. The cops just break it up and send them on their way. Tree probably didn't comply with the orders of the cops, so he became a collar. What I am telling you is this: breathe into a paper bag or something, but calm down. This is NOT a serious case. Putting a guy half your size into a coma IS a serious case, this one is not. But on the scale of what goes on at some other schools it's relatively small. It should be noted that his companion, Eriel Parra, faces the additional charge of "obstructing official business." So Parra is accused of creating problems that Tree did not. Whatever disagreements any of us may have over this, I think most of us want it to turn out when all the facts are in that Tree was not the instigator and that he may have been drawn in to try to break up a dispute and got caught up in it. How about a true story: In my younger and wilder days, I spent quite a bit of time in bars. I was a quiet drinker, but the bars were filled with loud, belligerent types. One time a fight broke out at the table next to me, and I tried to step in and play peacemaker. To someone looking across the room, it may have appeared that I was one of the aggressors. All of a sudden I got hit in the head from behind with a chair, and then I got pissed. I started to wade in when a friend grabbed my arm and pulled me out through the front door. As we looked over our shoulders on the way out, the whole bar had erupted into a sea of flying fists and flying chairs. We trotted down to the corner just as the police arrived. Had I stayed behind, I might have been arrested for being involved in a fight when I had, in fact, started out trying to break it up. As has been previously mentioned, the big lesson here is that bad things happen in bars, especially after midnight. Trying to figure out all the details from a brief news story is just plain silly. Of course it is important. At his size, if he wanted to kill the averaged size person, that person would be dead. In this case, after "repeated punches" etc, the person was not even injured. Thus, it is fair to say he was not really "fighting" in any real way. Again, in my State at least, to have an assault you must have an injury. And we don't have any such thing in Law as "attempted" assault. That one drops to harassment, a violation not a crime. So yes of course he should not have been in the bar at 2AM on the day prior to a road trip. No, he does not have a "right" to be in a bar if he is under 21. BUT, he is still a college kid doing college kid stuff. If the charges were burglary or rape or CPW I would be much more concerned about his character. Um, yeah, it is...considering that's what he is mainly being charged with. If he didn't really harm the DJ in any way (which he didn't), doesn't that affect the allegation that he assaulted him? As for the DJ being a Zip fan and lying, that's a bit far-fetched, don't you think? I love the Zips, but I'm not sure most people in this area know who Demetrius Treadwell is, and/or would cover for him if he just kicked their ass. Again, the story doesn't add up...he messed up, but that the truth isn't nearly as bad as the ABJ made it out to be. That should be evident once the full details come out.
