  1. Man, I thought ZN.O was the one place I could escape chain e-mails. I sure hope this doesn't start a chain reaction on this forum. After all, most of us already get way too many of these things in our e-mail boxes, and they all say to "pass it on."

  2. I missed the Law and Order episode where they distinguished technical legal precedent from nontechnical legal precedent,and actual precedent from nonactual precedent. I also missed the one where they explained that legal precedent only applies when one of the parties to the present suit was also a party to the precedent setting suit. Specifically, I did not realize that Ken+ couldn't use the outcome of a similar case involving any university and contract breaching coach as precedent. I have got to start watching that show. :)

    There's nothing new about how these deals work. I checked with former Can't State athletic director Laing Kennedy, who negotiated Ford's contract. He said it's the same protection clause that was in the contracts of previous coaches who left before their deals expired.

    According to Kennedy, when Gary Waters went to Rutgers in 2001, Can't State received about $200,000. When Stan Heath departed after a single season for Arkansas in 2002, it was a $750,000 buyout. For Jim Christian to Texas Christian in 2008, it was about $350,000.

    "It was never a problem being paid," said Kennedy. "We usually got the checks in a week or two."

    Can't State used much of the buyout money to pay the salaries of their new coaches, according to Kennedy.

    It looks like they have a good precedent to argue for getting paid. :wave:

    $1.2 million dollars. That makes an impact in a MAC Athletic Department budget.

    Just to clarify, Can't State is highly, HIGHLY unlikely to see a $1.2 million dollar payout on this. Even if the case eventually does go to court, which in all likelihood it will be settled for a much smaller dollar amount well before it ever sniffs a jury, these types of liquidated damages clauses are just not favored much in the courts. The courts will likely look at that big, $1.2 million dollar figure and say you are essentially trying to put a barrier in front of the guy ever leaving his position. They will likely look at it as a loose form of indentured servitude (we've got a big problem with that in this country) and would be very hesitant to issue a judgment anywhere close to that amount.

    It really is puzzling to me why Can't State is continuing to push this. They are unlikely to receive a payout that is going to cover their costs, it is going to have a deterrent effect on future coaching hires, it isn't going to bring Geno Ford back. It just seems like leftover bitterness and animocity is clouding their judgment to the point where they are making a bad decision just to try and screw with Ford and Bradley.

    He signed a contract. @ $300k/year. He knew he'd be on the hook for 1.2 million if he departed with 4 years remaining.

    300k/yr in Portage County is a ton of money. And now he's at 700k/yr, plus perks. We should all be so burdened with indentured servitude.

    Its been my experience that things are put into a contract for a reason. He signed it and if he didn't get adequate legal representation at the time, thats his problem. Maybe he can get Judge Judy or Judge Joe to feel sorry for him and let him off the hook. :nutkick:

    Can't State University is seeking $1.2 million from former men’s basketball coach Geno Ford, alleging he broke the terms of his contract when he joined Bradley University in March.

    In a lawsuit filed April 26, Can't State says Ford ended his employment without permission and never paid the damages he owed the university for the four years remaining in his contract, which would have expired in 2015.

    Shortly after 9:30 p.m., the school announced Ford as its new head basketball coach, before Ford had alerted the Can't State Athletic Department or his players.

    Players on the Can't State basketball team were upset they learned about Ford’s departure via a press release on Bradley University’s website, rather than in person from their coach.

    “It’s not that he left,” Can't State forward Justin Greene said previously. “I know this is a business. It’s how he left. You couldn’t tell us?”

    I just don't get this Ohio-Wyoming recruiting pipeline (if you can even call it that). The Buckaroos had a starting point guard from Youngstown during Joby Wright's era -- and that incredibly quick guard who transferred to OU. I've been to Laramie. Spent a week there one day.

    I think in Nances case, it has more to do with the fact that Shyatt was at one time the head coach at Clemson, Larry Nance Sr's alma mater.

    I had Flossie for class, we watched movies all day.

    My Flossie highlight was being awakened by him hitting the floor because he fell out of his chair as he struggled to pass a kidney stone. The best part of this story? During conditioning he wouldn't let his players get water because "water is for the weak". So during this kidney stone passing, Flossie screams out, hurry somebody get me something to drink, I need some water! Antonio Pittman screams out "Hell no Flossie, water's for the weak remember!"

    Funny stuff, but he was obviously in a lot of pain, they had to take him out in a stretcher. I think we were watching "Patriot" with Mel Gibson that day, :lol:

    Tim learned a lot from the Babe. :rolleyes:

  10. Things are escalating, with Flossie being investigated for abusing a player. It looks pretty obvious to me that this is retaliation from the school district.

    This kind of action by Flossie is not anything new. He has been guilty of this before and was a big reason he was fired at Barberton.

    He really is a mean spirited, grumpy, old man. His quote from the first article "over my dead body" showed that. But yeah, nothing new from him.

    Rarely do you get to see one poster so eloquently tell another poster to go "F" himself.

    For future reference I speak the truth, there are a lot of masochists who post on the basketball portion of the board on a regular basis. They believe their opinion is final because they attend every game and someone who sees the team only a few times a year can't possibly have a good opinion. A good way to analyze the Zips is to watch what the masochists post, and think the opposite.

    Another good way to see how the Zips are playing is to look for how and if Zip Watcher posts about a game. He's a good poster and a smart basketball observer. Sometimes his man crush on KD causes him to overstate how good the team may be, but everyone has their reasons for what they say. If the Zips are stinking up the JAR, you won't hear a word from him. He lives by the rule that if you don't have anything good to say, don't say anything at all. If the Zips are playing well, evidence of the "building process" is evident.
