He stole a water pipe worth $447 before taking off. No one was injured. Brunswick police later located Cunningham in a driveway on Clemson Drive just after midnight. He admitted to the robbery and was taken to the Medina County Jail where he posted a $30,000 bond and was released. Cunningham is charged with aggravated robbery. Crime rates seem to be going down in various categories and I hate to see one of our own cause it to go up. Hard to say why someone commits a crime like this. Sociopaths come from all walks of life and family types. It could be anything from he is an idiot to maybe there is some mental illness there that causes him to act out. If he is an idiot, good riddance. If he has some sort of mental illness that causes this problem, we should feel sorry for him and hope he gets well. It just makes no sense at all that a gun was needed to make a quick grab and run. For a scholarship student with no prior record to make such a poor decision on such a trivial item makes me think he must have been chemically impaired at the time. I don't know if anyone watches Vice on HBO, but last night they had a great story on heroine and everyone should watch it. Use a gun in commission of a felony you get 3 years 'wild' with whatever time you get for the underlying offense. BUT, if he has a REAL good atty. he might get it reduced. (A) Imposition of a three-year mandatory prison term upon an offender under division (B.)(1)(a) of section 2929.14 of the Revised Code is precluded unless the indictment, count in the indictment, or information charging the offense specifies that the offender had a firearm on or about the offender's person or under the offender's control while committing the offense and displayed the firearm, brandished the firearm, indicated that the offender possessed the firearm, or used it to facilitate the offense. The specification shall be stated at the end of the body of the indictment, count, or information, and shall be stated in substantially the following form: "SPECIFICATION (or, SPECIFICATION TO THE FIRST COUNT). The Grand Jurors (or insert the person's or the prosecuting attorney's name when appropriate) further find and specify that (set forth that the offender had a firearm on or about the offender's person or under the offender's control while committing the offense and displayed the firearm, brandished the firearm, indicated that the offender possessed the firearm, or used it to facilitate the offense)." (B.) Imposition of a three-year mandatory prison term upon an offender under division (B.)(1)(a) of section 2929.14 of the Revised Code is precluded if a court imposes a one-year or six-year mandatory prison term on the offender under that division relative to the same felony. © The specification described in division (A) of this section may be used in a delinquent child proceeding in the manner and for the purpose described in section 2152.17 of the Revised Code.
